Israel’s “courts have lost their way, which is exactly why judicial reform is so badly needed.”

The scenes from Yom Kippur in Israel, where misguided “protesters” attacked Jewish people attempting to worship according to their faith, breaks my heart.  Let’s take a step back and analyze what’s happening.

There are two core problems here.  First, Israeli courts are enacting discriminatory measures against Jewish people while treating other faiths differently.  Second, protestors find it appropriate to use Yom Kippur to harass and attack Jews praying — in the one and only Jewish state.

In any other country, if Jews were attacked, praying on the highest of holy days, according to the precepts of their religion, we would rightly condemn this as antisemitism. Yet somehow, we have come to the point that, in the Jewish state, law abiding Jews can’t pray freely without being spat on. Screamed at. Harassed. Are they trying to incite a civil war? And the biggest tragedy is that this is “Jew on Jew violence.”

Or is it? Who is funding these lawfare attacks against Jewish worshipers? Who is funding these so-called protests against Jews praying on Yom Kippur? In my experience, fighting against the Lawfare attacks on the Jewish state, it’s usually foreign funded NGOs.

I’m declaring a state of emergency and appealing to Israeli lawmakers to launch an investigation into foreign funding of lawsuits aimed at de-Judaizing our one and only homeland. I’ve seen these lawfare attacks before, for example against the Israeli Defense Forces, lawsuits forcing them to serve leavened bread during the seven days of Passover (as though there is some sort of human right to stuff your face with bread). Similar legal attacks against Jewish hospitals forcing them to provide non-kosher foods during holidays, making the hospitals unwelcome for observant Jews.

The greatest threat to Jewish sovereignty and our homeland is foreign-funded Lawfare. That’s undeniable.

On the other hand, there are no demands to put up gender separators at non-orthodox services, no one is proposing laws to prohibit mixed services in public spaces, yet some think they can enforce their militant secularism on Jewish worshippers. Only Orthodox Jews are being targeted in the Jewish state. Where does that leave us?

Almost my entire family, who identified as Orthodox Jews in Europe, were wiped out by Nazi forces, who viewed it as their mission to de-Judaize the world.  Who would have thought that I would live to see the day that the Jewish state was discriminating against Jewish people worshiping on Yom Kippur.

It’s plain to see that Israeli courts are being used as a tool to persecute observant Jews, as they have effectively made a law saying that orthodox prayer in public spaces is illegal in Tel Aviv. What has resulted is the situation where Orthodox Jews are no longer welcome in public spaces on Tel Aviv during prayer. This is unacceptable to me, and this should be unacceptable to everybody who is reading this thread.

If these are the kinds of decisions that the Israeli Supreme Court is making — no wonder people think the Supreme Court is ridiculous. Debasing itself really.

In 2023, Israeli courts issued verdicts protecting Muslims, and their rights to public prayer (every day, I hear the Muslim call to prayer in public places in Israel).  Islamist terrorists, who have murdered innocent Jewish children, once detained, receive more protections in Israel than in any other democracy.  The fact that precedent is no value here, that there is a total absence of checks and balances and that courts rule differently for one faith than they do for others, means that the rule of law is absent, and in its place, blatant discrimination against practicing Jews.

And of course, non-Muslims are forbidden to pray on the Temple Mount by judicial decree.

The courts have lost their way ,which is exactly why judicial reform is so badly needed.

An Israeli minister’s tweet on Tuesday calling for unity among Jewish people on Yom HaShoah (Holocaust Remembrance Day) was slammed by left-wing critics for allegedly being similar to a Nazi-era slogan.

“One nation! One flag! One country! We will remember and not forget,” Education Minister Yoav Kisch wrote on Twitter underneath a photo of himself and Israeli students at the March of the Living, an annual event in Poland commemorating victims of the Holocaust.

But some left-wing activists interpreted Kisch’s tweet as bearing resemblance to the Nazi slogan “one nation, one Reich, one leader.”

Although Hebrew-language news site Walla reported that Kisch’s tweet had sparked a backlash, the response appeared to be limited to far-left activists on Twitter.

No Israeli lawmakers from the opposition parties criticized Kisch’s tweet; nor did the heads of prominent NGOs or Holocaust memorial organizations.

Civil rights attorney Brooke Goldstein, founder of the End Jew Hatred movement, told World Israel News that the left-wing criticism of Kisch’s comments were nonsensical.

“This is absolute insanity. There is nothing wrong with declaring, with pride, that the Jewish nation is one nation, with one flag,” Goldstein said.

“All of this progressive woke hysterics is counterproductive. I moved from the United States because of idiocy like this. Let’s not infect our great country.”

In Israel, Yom HaShoah is typically a day of national unity, in which citizens unite across political and cultural barriers to mourn the victims of the genocide. However, this year’s Yom HaShoah was marked by incidents of stark politicization.

An El Al pilot on a New York-bound flight chose to compare potential reforms to Israel’s judicial system to events in Nazi-era Germany and insinuated that a Holocaust-like atrocity could occur in Israel should the court overhaul take place.

Also on Tuesday, Yom Hashoah, Likud MK Boaz Bismuth was harassed during a memorial event in a Tel Aviv synagogue by anti-government protesters. Despite some attendees asking the demonstrators to respect the sanctity of the event, the heckling continued until Bismuth was forced to leave the premises, fearing the event would turn violent.

The Nassau County Legislature has declared that End Jew Hatred Day will be recognized annually, The Lawfare Project announced Wednesday in a press release.

The date for the annual event is April 29.

In Nassau County, located immediately east of New York City, there has been a rise in attacks against the Jewish community, including flyers filled with hate messages that were distributed recently in Rockville Centre, Long Beach and Oceanside.

“We are thankful to Nassau County for recognizing the importance of standing up against Jew-hatred,” Brooke Goldstein, founder and executive director of The Lawfare Project, stated.

“This annual day of recognition shows the strength of the Jewish people and our allies. It is no longer acceptable to stand idly by as a minority group is openly discriminated against, week-in and week-out.”

Referring to the End Jew Hatred as a Jewish civil rights movement, Goldstein said the annual event “marks the start of a wider initiative to spread awareness about, and fight, the rise in Jew-hatred across the country.”

“We must unite on ending Jew-hatred, and thus, make progress towards being a more inclusive, safe society,” Nassau County Executive Bruce Blakeman’s official proclamation, issued on June 28, reads. “Hate crimes have increased drastically in the past several years, demonstrating that we must be vigilant against the growing threat of anti-Semitism.”

The Holocaust Museum & Center for Tolerance and Education is mentioned in the proclamation, expressing a commitment “to making our communities safer and more inclusive for all people.”

The first End Jew Hatred Day proclamation was signed into law on April 29, 2022 by New York State Senator Elijah Reichlin-Melnick.

CUNY Chancellor Felix Matos Rodriguez failed to show up at a hearing Thursday regarding antisemitism on its campuses, instead sending a lawyer to represent him, the New York Post reported.

The turnout at the Council’s Higher Education Committee hearing, titled “Examining Antisemitism on College,” was well-attended, with students and teachers who suffered antisemitic abuse providing testimony.

“Last night, in a very cowardly fashion, the chancellor said he won’t appear. Instead he sent a lawyer to represent him. What a sham, what an insult to the Jewish community of New York,” said Brooklyn Councilwoman Inna Vernikov, the Post reported.

“Amazing turnout today on the steps of city hall for the press conference on systemic Jew hatred at @cunyedu,” said Brooke Goldstein, director of The Lawfare Project and an End Jew Hatred activist.

“It’s disgusting that the CUNY chancellor refused to show up today, when the hearing was rescheduled just to accommodate him.

“He should resign,” she stated.

“When it comes to Jews, do Jewish lives matter?” asked Vernikov, a Ukranian-born Jew who is the ranking Republican on the Council’s Education Committee, according to the Post.

Among those who testified was former CUNY School of Law student Rafaella Gunz, who said she transferred to Yeshiva University because she “feared for my physical and emotional well-being,” the report said.

“It is horrible for Jews on campus,” declared Michael Goldstein, an adjunct professor of Communications and Government Relations at CUNY’s Kingsborough Community College in Brooklyn whose father, the late Leon Goldstein, was the school’s president for 29 years and the man who built the college’s modern-day campus.

In February 2019, Goldstein wrote in an article published in the New York Daily News saying he was the victim of “a systematic and pernicious campaign in which I have been targeted and harassed because of who I am and what I believe.” Goldstein is “Jewish, politically conservative, and I believe in Zionism, the civil rights movement of the Jewish people.”

Reporter for the Qatari-based news agency allegedly had her hand “broken,” but after her release she gives a TV interview appearing to be unhurt.

The Al Jazeera reporter arrested on the weekend in Jerusalem said Sunday she thinks the Israeli authorities “are afraid from the media.”

Al Jazeera journalist Givara Budeiri was arrested by Israeli police Saturday in the Sheikh Jarrah neighborhood of Jerusalem that has turned into a media hotspot over the pending evictions of several Arab families from Jewish-owned buildings.

Israeli police claimed that Budeiri shoved an officer after being asked for her identification, but the network issued a statement saying the arrest was “unacceptable” and it “demands answers.”

Budeiri was handcuffed and taken away by two border policewomen but released several hours later.

Al Jazeera is known for its biased coverage of Israel. Network officials stated that Budeira suffered a broken hand in the altercation. A picture posted to Twitter by a Palestinian journalist showed Budeira with her left arm in a cast.

It is not clear how Budeira received the injury or how serious it was, because in an interview posted by fellow Al Jazeera correspondent Nida’ Ibrahim after Budeira’s release from police custody, she is seen waving both hands in the air, including her left arm, apparently uninjured.

Budeira said that in her 21 years of reporting, “this is the first time I see this thing on the ground,” saying Israel was trying to “shut up” Al Jazeera.

“They wanted first Al Jazeera so everybody will [be] afraid. It was clear that they afraid from media,” Budeiri said.

Last year, the U.S. Department of Justice ordered Al Jazeera‘s affiliate AJ+, which operates in the United States, to register as “an agent of the Government of Qatar” under the Foreign Agents Registration Act, or FARA. That law requires entities and individuals considered to work on behalf of a foreign government to register with the DOJ as such an actor, thereby requiring them to disclose their funding and relationship with any foreign government.

The Al Jazeera Media Network “is little more than a mouthpiece for the Qatari regime. This foreign government uses AJ+ as a platform to spread Jew-hatred and anti-American propaganda in the U.S., promoting Qatari foreign-policy priorities,” said Brooke Goldstein, executive director of the Lawfare Project, a nonprofit organization that works to protect the human and civil rights of Jewish and pro-Israel communities worldwide.

Brooke Goldstein has long been involved in defending Jewish legal rights. In 2010 she founded the Lawfare Project, whose mission is to provide “pro bono legal services to protect the civil and human rights of the Jewish people worldwide.”

Goldstein’s experience has led her to conclude that a “paradigm shift” is necessary in the way Jews advocate for their civil rights – that what is needed is no less than a Jewish civil rights movement.

That there has never been a Jewish civil rights movement will come as a surprise to some, given that Jews have stood in the forefront of the civil rights movement for other minorities, particularly blacks.

But as Goldstein notes in an August 2020 Newsweek op-ed: “We cannot seem to gin up even a small fraction of this enthusiasm and support when members of our own community come under attack.”

Goldstein recently spoke with World Israel News.

Q: What made you start the Lawfare Project?

“I was working for Daniel Pipes and the Middle East Forum.

“That’s when I first came into contact with the phenomenon of lawfare, which at that time we defined as the use of the law as a weapon of war to silence those speaking out against radical Islam or speaking on issues of national security.

“I saw that there were millions of dollars going toward these sorts of frivolous, malicious lawsuits and on the other hand I also looked at other litigation, like that brought by the ACLU and NAACP, and saw how civil rights law firms could be used for good.

“The Jewish community was the victim of lawfare suits that were designed to hamper our community. At the same time, we had not organized a legal defense for ourselves, nor had we organized a legal offense to ensure that there is equal protection of the law for our community.”

Q: What would you say is the most important case Lawfare is involved in just now?

“The case that we brought on behalf of Psagot winery, first before the French Conseil d’État [Council of State] and later before the European Court of Justice, argued against the discriminatory labeling of Jewish products in Judea and Samaria. And even though we lost the case, what is significant is that in the end we won. We won in the court of public opinion.

“Among other things, it really pushed the U.S. government to declare – when Secretary of State Mike Pompeo visited Psagot winery – that U.S. policy is to officially label Jewish products made in Israel – ‘Made in Israel’ – to label them  correctly.

“Similarly, we lost a recent case in which the European Court of Justice ruled it was perfectly legal according to EU law to ban kosher slaughter, to ban religious slaughter.

“Those cases, although we lost, I think are super important because they’ve sparked a public dialogue about what religious freedoms are and where the EU is headed if not to a place of incredible darkness.

“Now of course there are cases that we’ve won and cases which we’ve settled. For example, we settled with San Francisco State University. For the first time, a U.S.-government entity, the California State University system, declared in a binding settlement agreement that it recognized Zionism as an integral part of  Jewish identity. Therefore, discrimination against Jewish students because they’re Zionists is a civil rights issue and is akin to discrimination against a Jewish person because of his cultural, ethnic and religious identity.

“Another case we just settled was against the National Lawyers Guild, which supported BDS.  We got it to reverse its boycott policy and declare it does not support commercial discrimination based on protected categories such as national origin. That was a huge win and also sent a signal to anyone else, especially in New York State, that if you attempt to engage in an unlawful discriminatory boycott, you will be held accountable.”

Q: You say before the Lawfare Project, “there was not a single entity dedicated to impact litigation on behalf of Jews.” How do you account for this when Jews have been so active in the U.S. in promoting impact litigation on behalf of African-Americans?

“Exactly. Jews have always been at the forefront of the Civil Rights movement. But not only has there not been a Jewish civil rights litigation fund – there has never been a Jewish civil rights movement in the West. Ever.

“What we have done is throw a lot of money at what some call pro-Israel advocacy. And, obviously, helping to improve the image of the Jewish State is essential, but that’s not civil rights advocacy, and we’re losing when it comes to 21st century civil rights advocacy because we’re not speaking the language of civil rights.

“When somebody attacks a Jewish student on campus, the response shouldn’t be ‘Well, let’s debate occupation. Let’s debate a foreign conflict thousands of miles away.’ They’re using that  to target the student because he happens to be Jewish… The response is to talk about the Jewish community as a minority community deserving of equal protection.

“If you have a problem with the Chinese government’s handling of Covid, is it acceptable to turn around on a Chinese-American student and start spitting on him and calling him a dirty Chinaman and excluding him from school activities? No, that’s racist. But if you have a problem with the Netanyahu government or the way Israel is handling the so-called occupation, then you turn around on a Jewish student and spit on him and call him a Zionist pig and exclude him from events, which is what’s been happening to my clients. Somehow that’s acceptable because you’re debating Middle Eastern politics.

“And what do we do? We give our students pamphlets on how to defend Israel as a non-apartheid state. We don’t give them pamphlets about ‘Know your rights,’ ‘What is a civil rights violation,’ ‘What to do if you’ve been discriminated against because of your cultural or ethnic identity’. So that’s what the Lawfare Project does.

“When you go before a judge in a court of law, it’s not an affirmative defense to discrimination to say, ‘Oh, I’ve got a problem with a foreign government.’ But that’s what San Francisco State University attempted to do when we sued. They didn’t dispute the fact that Jewish students were excluded from the ‘Know Your Rights’ fair. They didn’t dispute the fact that the only Jewish student group on campus, Hillel, which is apolitical, was shut down – a first amendment violation.

“’Yeah, yeah, all that happened. We did shut them down. We did exclude them. But not because they’re Jewish, because they’re Zionists. And Zionism is a political point of view, so it’s OK to discriminate.’

“That’s the narrative that we need to tear down. You don’t do that by feeding into it, by debating a conflict and defending  yourself against false accusations thrown at a foreign government.”

Q: You noted in your Newsweek op-ed in August that the focus and money put into “pro-Israel advocacy” on campus was a “a strategic mistake.” Could you elaborate on what you meant?  

“No, I don’t think it’s a strategic mistake to fund pro-Israel advocacy. I think it’s a strategic mistake to think that you’re going to defeat Jew hatred by debating foreign conflicts. You’re going to defeat Jew hatred by asserting the civil rights of the Jewish community as a minority community with equal protection under the law.”

Q: You argue that “a great civil rights movement” is needed.  What would that look like?

“That would look like End Jew Hatred, which is the new grassroots civil rights movement that was launched only a couple months ago and now has over 15 official partner organizations, tons of social media activists, grassroots organizers, influencers, student activists, who are all coming together under the same banner. It is non-partisan and is not political.

“Accusations of anti-Semitism are being used as a tool to divide the Jewish community on partisan lines. When you do things like accuse Trump of being a Nazi or make analogies between ICE [U.S. Immigration and Customs Enforcement] and concentration camps, you deny the uniqueness of Jewish history. And for too long Jewish activists have been sucked into these so-called progressive left-wing movements that are mired in Jew hatred. They think that that’s what liberal and progressive means.

“So what End Jew Hatred has done is provide a platform whereby Jewish activists can mobilize around issues that everybody can agree on no matter what party you voted for. Everyone agrees that an 18-year-old should be able to attend university without being spat on and, frankly, beaten up.

“Some progressive organizations are trying to tell the community it doesn’t matter, ignore the Jew hatred. Go march in these movements because we don’t want to cede the space. That doesn’t breed respect, that breeds contempt. Jews need to march for Jews and demand that others march for us as we have marched for them. That’s what End Jew Hatred does.

Q: It sounds like you want to separate attacks on Israel from attacks on Jews. Do you think that’s possible?

“I don’t want to separate it. They are intrinsically connected because those who are physically attacking Jews are using Israel, or a so-called Israeli-Palestinian conflict, as an excuse. What I’m saying is that the answer is not then to go debate the Israeli-Palestinian conflict, the answer is to point out that projection of a foreign conflict on someone because of the color of their skin or their religion or their ethnic and cultural identity is the epitome of racism.”

The Lawfare Project has filed a complaint against Microsoft Corporation in the Courts of Ibiza, Spain on behalf of two Jewish plantiffs for offering Bing results that link to a website with extremely inflammatory anti-Jewish content.

This comes on the heels of a similar case in Spain involving Google LLC, following which The Lawfare Project secured a major victory.

Microsoft has failed to block access to the offensive, anti-Jewish, degrading, and unlawful search result, even after having received detailed information about the content in question.

This complaint could result in a search engine being found liable for third-party content for the first time, not only in Spain, but in other EU and EEA countries with EU-harmonized legislation on the liability of Internet service providers, intermediaries, and platforms.

Brooke Goldstein, executive director of The Lawfare Project, said, “It’s extremely irresponsible for Microsoft and Bing to allow this offensive, anti-Jewish content to continue circulating on the internet in violation of the domestic law in Spain and the EU Directives on the matter.”

Ignacio-Wenley Palacios Iglesias, Spanish counsel for The Lawfare Project, added “The permanent, ubiquitous, and everyday influence Internet service providers have on society as a whole cannot be understated.

“The impact of these providers requires a level of structure and responsibility to address the most extreme, illegal content created by third parties that now enjoy immediate global access via the internet,” he said.

Law Group: Companies targeted by the UN Human Rights Commission for doing business with Israeli ‘settlements’ will have legal recourse.

International firms targeted by the UN Human Rights Council (UNHRC) for doing business with Israeli communities in Judea and Samaria will have legal recourse, a US-based pro-Israel nonprofit law group noted this week.

It is expected that a “blacklist” of such companies will be published by the UNHRC by the end of this year — a move which both the US and Israel oppose and are lobbying against.

According to the Washington Post, the list could include Caterpillar, TripAdvisor, Priceline.com and Airbnb.

On Monday, the Lawfare Project issued a statement saying the purpose of the UNHRC’s potential action was “clear” — “to coerce the blacklisted companies into reducing or ceasing their Israeli operations, and/or to prompt other business entities (and consumers) to boycott or refuse to deal with the named companies.”

However, the Lawfare Project continued, “what the UNHRC seems to ignore, perhaps purposefully, is that compliance by business enterprises with the boycott of Israel can violate a slew of US federal and state laws.”

“It comes as no surprise that the proponents of the Israeli boycott — the Human Rights Council, NGOs, Arab League member states, and others — do not acknowledge the serious legal implications of actually carrying out the discriminatory conduct for which they advocate,” Benjamin Ryberg — the Lawfare Project’s chief operating officer and director of research — said. “If I attended a corporate board meeting and proposed a boycott of companies that do business with or in Israel — while simultaneously warning that doing so was unlawful, and providing a laundry list of potential harm to the corporation that could result — I would be laughed out of that meeting.”

“When corporations are faced with such proposals or consider implementing boycotts based on the HRC’s database, it is imperative that they are well-versed in the relevant laws so that they can act in their own self-interest, which is to firmly reject the boycott,” he went on to say. “To this end, the Lawfare Project drafted a comprehensive analysis of US and foreign law relating to the boycott of Israel, which we have disseminated to a number of Fortune 500 companies that have been or may be targeted. Our aim is not to threaten legal action, but to prepare these entities to protect themselves from liability that could ensue should they succumb to pressure from the boycott campaign.”

Lawfare Project Director Brooke Goldstein stated, “For years, the Human Rights Council has focused obsessively and disproportionately on Israel, while turning a blind eye to the most egregious and rampant human rights violators in the Middle East and around the world. With this blacklist, the HRC continues to unabashedly devote disproportionate resources to foment discrimination based on national origin. It continues to make a mockery of its mission to the detriment of human rights worldwide.”

Lawrence Hill — the chairman of the Lawfare Project’s board — said the UNHRC’s “farcical conduct” demonstrated the necessity of the Israel Anti-Boycott Act — which is currently making its way through Congress.

That legislation, in Hill’s view, is “the type of active US engagement that is needed to achieve game-changing reforms at the UNHRC.”
