U.S. Special Envoy Jason Greenblatt revealed that the administration’s peace plan calls for unification of Gaza and Judea and Samaria.

The yet-to-be-revealed U.S. peace plan for Israel and the Palestinians includes the reunification of Hamas-controlled Gaza and the Palestinian Authority (PA), Trump envoy Jason Greenblatt told Israel’s Ynet news Tuesday.

Greenblatt is the Special Representative for International Negotiations to U.S. President Donald Trump. He has been working on the plan for the past 19 months together with senior administration officials. His remarks attempted to dispel Palestinian claims that the plan calls for leaving Gaza a separate entity.

“Let’s be clear. Gaza and Judea and Samaria were separated for 10 years not only physically, but also politically between the Palestinian Authority and Hamas, denying the reality would be absurd,” Greenblatt said. “Contrary to [Palestinian] claims, the U.S. plan is to unite them,” he said.

“Make no mistake, we are here to help all the Palestinians, both in Judea and Samaria and in Gaza, and the disinformation that is being disseminated by those who are not exposed to the plan and want to spoil it does not help ordinary Palestinians,” he underscored, criticizing the PLO for disparaging the plan before seeing it.

U.S. officials have noted in recent weeks that the pending proposal will not require Israel to make concessions in the areas of security, but Prime Minister Benjamin Netanyahu “will have to demonstrate leadership and make difficult decisions.”

Trump expects both Netanyahu and Palestinian leader Mahmoud Abbas to respond positively to the plan and start negotiations on the basis of the proposals that it will include. Most Israelis will find that the plan is “quite logical,” a U.S. official said.

However, the Palestinians have rejected any notion of a U.S.-brokered diplomatic solution. They’ve boycotted Washington since December when Trump announced that the U.S. officially recognized Jerusalem as Israel’s capital, and they have escalated their rhetoric and actions against the U.S.

A viable plan?

Palestinian affairs expert Yoni Ben-Menachem, an analyst with the Jerusalem Center for Public Affairs, a leading Israeli think tank in the areas of security and regional diplomacy, believes Greenblatt’s plan is dead in the water.

Ben-Menachem said that the linkage idea is nothing new and had already been incorporated into the 1994 Oslo Accords. The Accords prescribed a “safe route” connecting Gaza to the PA, but following the security threats posed to Israel by the route, it was never implemented.

He further noted that the Hamas terror group which rules Gaza does not recognize the Oslo Accords, and therefore its implementation vis-à-vis Gaza is of no relevance.

Ben-Menachem says that the U.S. plan, as outlined by Greenblatt to Ynet, is naïve and irrelevant as long as Hamas rules Gaza. Israel has no plans to topple the Hamas government in Gaza. Therefore Hamas will continue to dictate policies in Gaza, and the U.S. plan isn’t feasible, he notes.

Abbas has no interest in unification, Ben-Menachem says, as it would only strengthen Hamas’ influence in the PA, a development detrimental to Abbas’s ruling Fatah.

Abbas wants to take control of Gaza. He has resorted to punishing Hamas by withholding salaries of civil servants and blocking humanitarian and other aid from reaching the Strip. The PA will vote at the end of the month whether to impose further sanctions. The PA will also vote to disband the Hamas-controlled Palestinian Legislative Council, the unicameral legislature of the Palestinian Authority.

Israeli opposition

Israel also views PA-Hamas unification negatively, Ben-Menachem said. This leaves the U.S. without a partner to the plan. It won’t “pass the test of reality,” he noted.

Israel would prefer to see Gaza connected to Egypt, not the PA, he says. Gaza was administered by Egypt prior to the 1967 Six Day War. As Egypt shares a border with the Strip, a plan to rehabilitate Gaza under Egyptian tutelage  is not impossible.

Ben-Menachem believes Greenblatt’s statements are a “trial balloon,” an attempt to air some of the administration’s ideas and see what reactions they elicit.

The Trump administration has good intentions, Ben-Menachem says, but Israel’s security necessities are paramount and in the current regional configuration, Israel will not be able to accept such terms.

Washington threatens to  close the PLO mission in Washington for asking the International Criminal Court to prosecute Israelis for alleged crimes against Palestinians.

The Palestinians threatened on Saturday to suspend all communication with the United States if the Trump administration follows through with plans to close their diplomatic office in Washington. The potential rupture in relations threatens to undermine President Donald Trump’s bid for Mideast peace.

Senior Palestinian negotiator Saeb Erekat said the US decision was “very unfortunate and unacceptable,” and accused Washington of bowing to pressure from Prime Minister Benjamin Netanyahu’s government “at a time when we are trying to cooperate to achieve the ultimate deal.”

In a video statement on social media, Erekat said: “We will put on hold all our communications with this American administration.”

There was no immediate reaction from the Trump administration. Netanyahu’s office said the closure was “a matter of US law.”

US officials had insisted before Erekat’s statement that the move wasn’t aimed at increasing leverage over the Palestinians, but merely the unavoidable consequence of US law.

Cutting off ties would carry great risks for the Palestinians. It could antagonize an administration they already suspect is biased toward Israel and put millions of dollars of critical US aid in jeopardy.

However, unresponsive Palestinians would deal an embarrassing blow to the Trump administration ahead of an expected peace initiative and potentially prevent it from getting off the ground. Their stance could also complicate US efforts to promote a region wide approach by bringing together Israel with Saudi Arabia and other moderate Arab allies in a joint effort against Iran. Arab countries might be reluctant to get too close to Israel in the absence of serious progress on the Palestinian issue.

The Cost of Palestinian Belligerence

The administration announced late Friday that the Palestinians had run afoul of a legal provision that says the Palestine Liberation Organization (PLO) cannot operate a Washington office if the Palestinians try to get the International Criminal Court (ICC) to prosecute Israelis for crimes against Palestinians.

Secretary of State Rex Tillerson determined that the Palestinians crossed that line in September, when Palestinian Authority (PA) head Mahmoud Abbas called on the court to investigate and prosecute Israelis, according to State Department officials. They weren’t authorized to publicly discuss the situation and spoke on condition of anonymity.

It wasn’t clear when the office would close or whether the Palestinians would have to clear out of the building entirely or just close it to the public. Riad Malki, the Palestinian foreign minister, said he was told by the Americans that US and State Department legal teams would meet Monday to decide how the new situation would affect the office, the functioning of diplomats and contacts with the Palestinians.

“We will wait to hear back from them,” Malki said. After that, the Palestinians will decide how to react.

Under the law, Trump now has 90 days to consider whether the Palestinians are in “direct and meaningful negotiations with Israel.” If Trump determines they are, then the mission can reopen, officials said.

PLO official Hanan Ashrawi said the US was “disqualifying itself as a peace broker in the region” by refusing to extend a waiver from the law.

“Conditioning the renewal of the waiver on the Palestinians’ sticking to ‘direct and meaningful negotiations with Israel’ is actually superfluous since negotiations are nonexistent, and the current US administration has yet to present any kind of peace initiative,” she said in a statement.

US Not Backing Away

The US said it wasn’t cutting off relations with the Palestinians and remained focused on a comprehensive peace agreement between Israelis and Palestinians. One of the US officials said in an email that “this measure should in no way be seen as a signal that the US is backing off those efforts.”

The Palestinians quickly dismissed that argument, with Malki telling Palestine Radio that the Palestinian leadership “will not accept any extortion or pressure.” Erekat contended the move was the result of “the pressure being exerted on this administration by the Netanyahu government.”

In response, the Israeli prime minister’s office said, “We respect the decision and look forward to continuing to work with the US to advance peace and security in the region.”

The Israelis and Palestinians are not engaged in active, direct negotiations. Trump’s team, led by Jared Kushner in his role as senior White House adviser, is working to broker a deal aimed at settling the intractable conflict.

The Palestinians, publicly supportive of the US effort, are nonetheless skeptical because Trump’s close ties to Israel suggest whatever deal he proposes might be unfavorable to them. The threat of losing their office in the American capital could become one more pressure point as the Trump administration tries to persuade the Palestinians to come to the table.

Have Palestinians Entered Into Meaningful Negotiations with Israel?

The PLO is the group that formally represents all Palestinians. Although the US does not recognize Palestinian statehood, the PLO maintains a “general delegation” office in Washington that facilitates Palestinian officials’ interactions with the U.S. government.

The United States allowed the PLO to open a mission in Washington in 1994. That required President Bill Clinton to waive a law that said the Palestinians couldn’t have an office. In 2011, under the Obama administration, the US started letting the Palestinians fly their flag over the office, an upgrade to the status of their mission that the Palestinians hailed as historic.

Israel opposes any Palestinian membership in UN-related organizations until a peace deal has been reached.

The Trump administration has not officially disclosed details about its effort to achieve an agreement that ostensibly would grant the Palestinians an independent state in exchange for an end to its conflict with the Israelis. Kushner and other top Trump aides have been shuttling to the region and meeting with Palestinians, Israelis and officials from Arab nations.

The requirement about the mission closing stems from a little-noticed provision in US law that says the US cannot allow the Palestinians to have a Washington office if they back the international court’s move to investigate or prosecute Israeli nationals for alleged crimes against Palestinians.

Palestinian leader Mahmoud Abbas said at the United Nations in September that the Palestinians had “called on the International Criminal Court to open an investigation and to prosecute Israeli officials for their involvement in settlement activities and aggression’s against our people.”

The US president can let the Palestinians keep the office despite the violation, only if certifying to Congress “that the Palestinians have entered into direct and meaningful negotiations with Israel.” The provision doesn’t explicitly define what would constitute direct or meaningful negotiations.
